Terms and Conditions

These terms of use (these ?Terms?) set forth the legally binding terms and conditions your access to and use of any websites, mobile sites, mobile applications, products or services (the ?Services?) offered by PE IVANUSHENKO LEONID (Deus.Video). (?Deus.Video?, ?us?, ?our?, and ?we?), a Private Entrepreneur registered in Ukraine with registration no. 3023202333 (?Deus.Video?, ?us?, ?our?, and ?we?). The ?Customer?, ?you?, ?your? shall refer to any natural person or entity and its authorized users that subscribes or uses the Services. Certain features of the Site may be subject to additional guidelines, terms, or rules, which will be posted on the Site in connection with such features.All such additional terms, guidelines, and rules are incorporated by reference into these Terms.

By accessing or using the Site, you are accepting these Terms (on behalf of yourself or the entity that you represent), and you represent and warrant that you have the right, authority, and capacity to enter into these Terms (on behalf of yourself or the entity that you represent).you may not access or use the Site or accept the Terms if you are not at least 13 years old.If you do not agree with all of the provisions of these Terms, do not access and/or use the Site.

These terms require the use of arbitration on an individual basis to resolve disputes, rather than jury trials or class actions, and also limit the remedies available to you in the event of a dispute.

We may amend the Terms related to the Services from time to time. Amendments will be effective upon our posting of such updated Terms at this location or the amended policies or supplemental terms on the applicable Service. Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms, as amended.

1. Accounts

Account Creation : In order to use certain features of the Site, you must register for an account (?Account?) and provide certain information about yourself as prompted by the account registration form. You represent and warrant that: (a) all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information. You may delete your Account at any time, for any reason, by following the instructions on the Site. Deus.Video may suspend or terminate your Account.
Responsibilities : You are responsible for maintaining the confidentiality of your Account login information and are fully responsible for all activities that occur under your Account. You agree to immediately notify Deus.Video of any unauthorized use, or suspected unauthorized use of your Account or any other breach of security. Deus.Video cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

III. Account types : We currently offer a free Account with limited functionality (?Free Account?), and various fee-bearing Accounts offering feature enhancements (?Paid Subscriptions?).

2. Subscriptions

We provide you access to our base Services for free, subject to our internal policies and your compliance with all applicable terms and conditions set forth in these Terms (?Free Account?). We offer you access to more content, functionality, and Services when you purchase a subscription. We offer several types of subscriptions with different benefits and pricing. Our subscription plans are described in the related page. If you elect to use Paid Subscriptions, you agree and acknowledge that you are bound by these Terms and our pricing schedule, which we may update from time to time. IF YOU ELECT TO USE OUR SUBSCRIPTION SERVICES, YOU CONSENT TO HAVE YOUR PAYMENT METHOD AUTOMATICALLY CHARGED AS SET FORTH BELOW AND AS DETAILED AT THE RELATED PAGE.

(a) Monthly Subscription. A monthly subscription commences on the date your Paid Subscriptions commence and continues thereafter for a period of one (1) month (?Monthly Subscription Period?). Upon expiration of the initial Monthly Subscription Period, your subscription will renew on a month-to-month basis for Monthly Subscription Periods unless and until you cancel your subscription or it is terminated by Deus.Video.

(b) Annual Subscription. Unless and until terminated, annual subscriptions commence on the date your Paid Subscriptions commence and continue thereafter for a period of one (1) year (?Annual Subscription Period?). Upon expiration of the initial Annual Subscription Period, your annual subscription shall automatically renew on an annual basis for Annual Subscription Periods unless and until you cancel your subscription or it is terminated by Deus.Video.

3. Content Restrictions

You may not submit any content that:

Infringes any third party’s copyrights or other rights (e.g., trademark, privacy rights, etc.);
Is sexually explicit (e.g., pornography) or proposes a sexual service;
Is defamatory;
Is harassing or abusive;
Contains hateful or discriminatory speech;
Promotes or supports terror or hate groups;
Contains instructions on how to assemble explosive/incendiary devices or homemade/improvised firearms;
Exploits or endangers minors;
Depicts or encourages self-harm or suicide;
Depicts (1) unlawful real-world acts of extreme violence, or (2) animal cruelty or extreme violence towards animals;
Promotes fraudulent or dubious money-making schemes, proposes an unlawful transaction, or uses deceptive marketing practices;
Contains false or misleading claims about (1) vaccination safety; or (2) health-related information that has a serious potential to cause public harm;
Contains false or misleading information about voting;
Contains conspiracy-related content where the underlying conspiracy theory makes claims that (1) suggest that a real-world tragedy did not occur, or (2) violate other content restrictions; or
Violates any applicable law.

4. Customer content

?Customer Content? means any and all information and content (including text, images, photos, videos, audio, and documents) that a Customer provides or makes available to Deus.Video in connection with the use of the Services. You are solely responsible for your Customer Content. You assume all risks associated with use of your Customer Content, including any reliance on its accuracy, completeness or usefulness by others, or any disclosure of your Customer Content that personally identifies you or any third party. You hereby represent and warrant that your Customer Content does not violate our Acceptable Use Policy.You may not represent or imply to others that your Customer Content is in any way provided, sponsored or endorsed by Deus.Video. Because you alone are responsible for your Customer Content, you may expose yourself to liability if, for example, your Customer Content violates the Acceptable Use Policy. Deus.Video is not obligated to backup any Customer Content, and your Customer Content may be deleted at any time without prior notice. You are solely responsible for creating and maintaining your own backup copies of your Customer Content if you desire.

5. Disclaimers

THE SERVICES ARE PROVIDED ON AN ?AS-IS? AND ?AS AVAILABLE? BASIS, AND DEUS.VIDEO(AND OUR SUPPLIERS) EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ALL WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT. WE(AND OUR SUPPLIERS) MAKE NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS, OR WILL BE ACCURATE, RELIABLE, FREE OF VIRUSES OR OTHER HARMFUL CODE, COMPLETE, LEGAL, OR SAFE.IF APPLICABLE LAW REQUIRES ANY WARRANTIES WITH RESPECT TO THE SITE, ALL SUCH WARRANTIES ARE LIMITED IN DURATION TO NINETY (90) DAYS FROM THE DATE OF FIRST USE. DEUS.VIDEO DISCLAIMS ANY AND ALL RESPONSIBILITY OR LIABILITY IN RELATION TO THE CONTENT MADE AVAILABLE THROUGH THE SERVICES, INCLUDING THE CUSTOMER CONTENT, OR ANY CONTENT OR SERVICES PROVIDED BY THIRD PARTIES. DEUS.VIDEO DOES NOT CONTROL OR VET CUSTOMER CONTENT AND IS NOT RESPONSIBLE FOR WHAT USERS POST, TRANSMIT, OR SHARE ON OR THROUGH THE SERVICES. DEUS.VIDEO IS NOT RESPONSIBLE OR LIABLE IN ANY MANNER FOR ANY THIRD-PARTY SERVICES ASSOCIATED WITH OR UTILIZED IN CONNECTION WITH THE SERVICES, INCLUDING THE FAILURE OF ANY SUCH THIRD-PARTY SERVICES OR SUPPORTED PLATFORMS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

6. Cancellation of Subscription

You may cancel your subscription at any time from within your account or by emailing customer support and requesting an account cancellation. Subscription cancellation does not trigger an account deletion. Your subscription cancellation date will be at the end of your billing cycle. Cancellations that occur within less than 5 business days of their billing cycle might be canceled at the proceeding billing cycle. Any money paid for subscription or money used to purchase content and/or system credits are not refundable. Upon cancellation of your subscription, all unused credits will be forfeited on the subscription cancellation date.

7. Deletion of account

We reserve the right to delete inactive or empty free accounts. If an account is inactive, we will attempt to notify you of the pending account deletion and will proceed to delete it and all its content thereafter unless you begin using your account again.

Subscription cancellation does not automatically trigger account deletion. If you wish to have your account deleted from our servers you must email us.

8. Jurisdiction

The terms of this agreement are exclusively based on and subject to Ukrainian law based on payment received country. The use of this website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including and without limitation to this paragraph.
